Kelly Gearhart’s trial delayed a third time

For the third time, former Atascadero “Person of the Year” and prominent North County land developer Kelly Gearhart’s trial has been delayed.

The court determined a failure to grant the requested continuance from June 11 to Nov. 12 “would result in a miscarriage of justice,” because Gearhart’s public defender Kim Savo would not have the time to prepare a defense.

In August 2012, Gearhart pleaded not guilty to 16 charges of mail fraud, wire fraud and money laundering at a federal court in Los Angeles. He faces up to 300 years in federal prison if convicted on all charges.

Gearhart and the former president of Hurst Financial, James Miller, have been accused of helping to defraud more than 1,200 investors of more than $100 million in an alleged Ponzi scheme. Miller and Gearhart bilked investors who put money into Central Coast real estate projects and then siphoned off the monies for other purposes, including maintaining lavish lifestyles, federal authorities alleged.

In the summer of 2011, Miller agreed to plead guilty to charges of fraud and money laundering as part of a plea agreement the court then filed under seal.

Why is SHE asking for a continuance? Who is at the helm here? The word you are looking for is protraction of the law. A common tactic used to garner delay after delay in the hopes that those involved in the case will die, move on, not be available. We experienced this during our case with Grigger Jones. Delay after continuance after delay…………………..

If I may follow up that last comment……….the prosecution I have been assured are acting with aggressive investigation and it would appear are making a very strong case. Sleep tight kiddies. The powers that be are doing their job and yes there will be a pot at the end of this litigated rainbow. Of course Kelly Gearhart and his Salinan partners Grigger Jones, Molina, and the insurance guy will not be enjoying those fruits, and as far as I have been told the Bank of Hawaii in our matter are interested in settling out of court……………….perhaps the tales of truth woven by Jay Miller have been heard after all. How is Jay Miller? Anyone?

By the time this goes to court I will be dead. Looking forward to going. God is there with His most beloved Son, Jesus, and the Holy family.


Unearnhart can ask for forgiveness and it will be given to him if he is sincere. We will not even care about money or hole’s in one or even eho got the biggest piece of pie. Sounds good to me.

I don’t forgive so easily. Perhaps we need someone out there who doesn’t rely on religion as an emotional support cushion and instead takes it up a notch.


RIGHT! I don’t know about you but MY JESUS would beat the crap out of Gearhart and ask him to pay back the money he stole. What would your jesus do?

These three things really tell you a lot about who I am: (1) a public defender, (2) a kid from New Jersey, (3) the child of a big, extended Arab-American family. I write poetry to make sense of my world. I graduated from TLC in 2008 and returned the following year to attend Grad I. I maneuvered to get my fellow ’08 grad, Stephen Demik, hired by my office so that I would have someone to do psychodrama with in my work. We have been working together on our cases and the cases of some of our colleagues. We have also been meeting with other local TLC grads to do both personal and case work. I continue to learn about myself through the process. I want to keep improving my skills so that I can do more for my own clients and also do more on behalf of my other colleagues. Being invited to be on staff makes me feel like a five year old who got invited to a birthday party with a bouncy house.


Public defender? I find that hard to believe. Just gives him more time to spend or hide all that money. Bet his entire family is set up for a lavish life. If he is facing 300 years, why is he not incarcerated? I don’t get it? What am I missing here?


They should just give him the chair, now. Public defender my ass, after ripping off 1200 people of over $125 million (via that crook Miller) he is now milking us again. What a system we have. Spit on the sidewalk and go to jail, steal many millions and skate free.


By the time this gets to court, Gearhart and all of us will have been dead for years.


Money talks…bullshit walks.

Ah but Jay Miller it would appear knows even more. Have faith. From what I have heard the wheels of justice are slow to turn in this case but they are definitely turning. This is going to be the west coast Bernie Madoff……very soon.


They should grant the Continuance but revoke his bail…
