California lawmakers battling ‘revenge porn’

porn revengeCalifornia lawmakers are attempting to reverse a growing trend of people posting naked photos of their ex-lovers on the Internet. [Wall Street Journal]

Earlier this month, the Senate approved SB 255, which would make the posting of “revenge porn” a crime punishable by a year in jail.

The Assembly Public Safety Committee will evaluate the revenge porn bill Tuesday.

Initially, the bill only applied to cases in which the victim did not consent to the taking of the photographs.

But, a newer draft of the bill prohibits the distribution of naked photos without the person’s consent and with the intent to humiliate the individual.

Republican Senator Anthony Cannella sponsored the revenge porn bill.

“Victims of this cruel act are often so humiliated that they pose a threat to harming themselves, as evidenced by numerous examples of cyber revenge victims who have taken their own lives,” Cannella said in a memo. “Cyber revenge and its ugly consequences should not be tolerated.”

In a real state you would think that our public servents had other things to worry about, like how much longer will Ca’s econmy hold up under the useless rules and regs we have,how Brown’s stupid train to nowhere is going to be a money pit and a disaster, how CA’s divorce laws make the wage earner loose everything to give an ex wife half of everything, or how about the problem with gangbangers and drugs that this state does virtually noting about,but nooooo we’re concerned about some one putting a pic of their once other half up for the world to see. Our public servents need a wake up call.

I used to say the same thing. Broke schools, corruption, looming state, county and city bankruptcies, seemingly no good jobs, thousands of laws and regs that nobody can follow so it all depends on who you know and who you piss off etc. etc.


And you know what? The state is still here and seems to be doing just fine. Real estate is back and going through the roof again. They even talked about a surplus this year and next.


So I gave up. Now, I just try to not pay attention.

Giving somebody a naked picture of yourself is just plain naive. If you can’t handle the possibility of the photo going public, then don’t be stupid enough to hand someone the ammunition. I suppose if the photo is given to a beloved beau who is being deployed or something, then that would be a different story but if you do that, make sure that you don’t send him any Dear John letters and get the picture back when he comes home.

Who says it was given? Every phone out there has a camera. Your boyfriend catches you in the shower. Your boyfriend snaps a pick in the heat of the moment or while your dressing. What are you supposed to jump him and rip the camera out of his hand and delete the photo?

Hope you are talking about the person who posts the nude pictures as revenge. Anyone who does that is a serious a-hole and gets no sympathy from me.


So for this, they decide to make the law “OPT IN” whereas everything else has to be OPT OUT. Nice.


If anyone in government truly gave a rat’s behind about any modicum of privacy (or 4th Amendment), ALL information would be an OPT-IN ONLY. Make the people profiting from our info pay and do all the legwork. Seriously, it is not that difficult to figure out. They did with this “porn” legislation. Wonder who’s wife/daughter/relative was burned to get this going…


This would be solid law if revenge divorce was included because the operative word is “revenge”, a dish best served cold.
