OPINION by KEVIN RICE

The San Luis Obispo City Manager’s attempt to write the “rest of the story,” seal it with a kiss, and close the book is a disingenuous sham. This criminal act is not cured with an apology and paid training class.

Police Chief Deanna Cantrell has committed  a crime and should be terminated immediately.

Penal Code 25100: …a person commits the crime of “criminal storage of a firearm in the second degree” if all of the following conditions are satisfied:

(1) The person keeps any loaded firearm within any premises that are under the person’s custody or control.

(2) The person knows or reasonably should know that a child is likely to gain access to the firearm without the permission of the child’s parent or legal guardian, or that a person prohibited from possessing a firearm or deadly weapon pursuant to state or federal law is likely to gain access to the firearm.

(3) The child obtains access to the firearm and thereby causes injury, other than great bodily injury, to the child or any other person, or carries the firearm either to a public place or in violation of Section 417, or the person prohibited from possessing a firearm or deadly weapon pursuant to state or federal law obtains access to the firearm and thereby causes injury, other than great bodily injury, to himself or herself or any other person, or carries the firearm either to a public place or in violation of Section 417.

All of the above conditions have been met.

This crime becomes a felony if death or great bodily injury results.

The next Kate Steinle is now at risk. Only time will tell.

While I think she fucked up and should be reprimanded, not 1 of those 3 conditions you mentioned apply. Her weapon isnt the same as just any gun. It’s a service revolver. The law you mentioned isnt for this situation. The real crime that occurred was by Morra Bay PD. They used the story to take action against one of their residents who they have a hard on against. Lied and said the suspect looked the same, so they entered his place with no warrant to find the gun. No gun, but they found some drug paraphernalia in a bedroom drawer and proceed to charge child endangerment, because kids were living in another bedroom. Somebody needs to investigate those guys…..

“All of the following conditions are met”. How is (3) met? A child did not possess the gun, cause bodily injury, or take it to a public place. The same requirements apply to a an adult not allowed to possess a firearm. Even if the person who took it was not allowed to possess a firearm, they did not cause bodily injury or take the gun to a public place.

The chief has admitted to forgetting her firearm. And, the media (Tribune & KSBY) have lionized her for being so forthcoming and transparent about the incident.

However, it is common knowledge around SLOPD that the incident was not reported for 12 hours or perhaps more.

I would like the chief and the city manager to state publicly, who and when she talked to and what was disclosed from the time the firearm was discovered missing until it became public knowledge.

I’m betting it was a long time on the QT!!!

There are dozens of recorded incidents nationwide of Police Chiefs, sheriffs and other high ranking Law Enforcement Officers who have lost or misplaced their guns. Zero got fired over it. Show us one instance where a Police of Chief who lost their gun was fired over it. I’ve read several articles so far about high ranking Law Enforcement losing their guns. yes it was embarrassing. But Rice is so seething with hate he can’t help himself. Had this of been a Wall Building, gun toting, dirt bike riding, cowboy hat wearing good ol’ boy, you wouldn’t here a squeak from the alt right. (Rice) Wouldn’t have anything to do with who she is would it? You’d have more credibility if you didn’t have such an abysmal track record.

It has everything to do with who she is, or isn’t! Just read some of the bigoted homophobe comments when CCN did the first piece on this incident and you’ll have no doubt how most here feel about her.

Everything I’ve read on “losing” a gun in California says nothing about losing one being a crime; not reporting it within a certain time frame is though; and from what I’ve read Chief Cantrell was well within that time constraint.

One other thing… Kevin quotes from the portion of the code that deals with a child being able to have unfettered access to a gun, like that has anything to do with this at all. They addressed the one child that could have had access and he didn’t, so none of the three (3) conditions Kevin puts forth apply so there’s no criminal case.
