O’Malley threatens mayor with alley brawl

May 23, 2008

By KAREN VELIE

Atascadero City Council member Tom O’Malley challenged Mayor Mike Brennler to handle a dispute regarding council procedures his way, man-to-man out in the parking lot, said numerous attendees of Thursday’s “public trust and campaign reform workshop.”

During the conciliatory-turned-contentious meeting, O’Malley interrupted and argued with a speaker during public comment. Brennler asked O’Malley to let the speaker finish. When it appeared O’Malley couldn’t hear the mayor over the altercation, Brennler began waving his hand at the council member.

“If you don’t stop shaking your hand at me, we are going to have to meet out back in the parking lot,” O’Malley is reported by numerous witnesses to have said.

O’Malley did not respond to requests for comment.

Late last year, the council voted to hire a mediator at a cost of around $9,000 to oversee a series of meetings designed to help city leaders develop skills needed to foster publics trust and confidence. At the first meeting a few months ago, O’Malley is reported to have hurled insults and argued with Brennler and Tom Shanks, the mediator.

Shortly before O’Malley’s latest threat, Suzy Anderson, a member of “A Better Atascadero,” — a political action committee — accused council member George Luna’s wife Ursula of taking certain actions during an election eight years ago.

George Luna said he was not going to listen to “lies,” and walked out of the meeting. Anderson later said she was not speaking on behalf of her group.

Following lunch, Luna returned, and Brennler asked attendees to follow meeting decorum and refrain from personal insults and requests for fist fights. Shanks put a limit on public participation, and the focus turned towards public finance reform.

Did you mention a loan on the old city hall? Now here is the story. The only value on that building is the land. If you read all of the reports and estimates of cost to repair the building only it is easily a $50,000,000+ project just for renovation only. These figures are documented and available for public scutiny. Unfortunately no one in the city will touch this with a 10' pole. To hot of a political topic.

Anyone that would lend this city $6,000,000 needs to get in line with the lending practices of EFI, Hurst, all of the other hard money lenders, possibly Heritage Oaks and First Trust Bank.

First you would want to check the financial sheet for the city, any investor would stop there. Because of that you would have to consider that the only avenue for a loan then would be hard money. Oh, least I forget the city may want to try Orange County again.

I can't wait for the podcast to become available. This would have to be an unbeleivable development that really needs uncoveredslo.com to pursue.

Did anybody catch that comment last night that the CC entered into some kind of 6 million dollar loan on the old city hall. Did I miss something. Are they hiding thier mistakes with the printery financing in the City Hall building. Does anyone know what that was about? It was said in passing and they all looked like they had some bird feathers hanging out of thier mouths.

Are you kidding Broadwater has always been a fanatic. Check out almost any CC meeting tape. He's on it. And always wound as tight as a Swiss watch. Since Tom Comar kept his wife a secret maybe David is his son. They definitely have some personality similarities.

By: Anonymous on 5/28/08

Dan and I will be on Dave Congalton's radio show tonight at 6:05 p.m. to discuss this story. Tune into KVEC 920 AM or listen live at 920KVEC.com.

In my part of the country "he needed his ass kicked" is a legal defense…let the games begin…

By: Anonymous on 5/28/08

Afer reading all this crap that the good folks of atascadero have posted here, I believe that ASH is here for your convenience…gas being high and all.

By: Anonymous on 5/28/08

We need to give David Broadwater a little break here. Remember that he lives next door to Tom O'Malley. We've seen the antics of Tom, Jeckyl and Hyde. Poor David is probably on pins and needles wondering what Tom will do whenever they meet outside.

Maybe the answer to all of this would be for Broadwater and O'Malley to meet with Comar, a former nurse at ASH, and have their medication altered.

By: Anonymous on 5/28/08

Wrong again. I do think that if the City Councel has any sense it will have the Boy cops pat down Broadwater and Comar before letting them enter the chambers from now on. I'll bet it is a full time job for Lee Perkins just the keep thier medications right. The person who thinks they can anylise my blog because they have some degree from polly should take a close look at the recordings of Broadwater and Comar at the City Councel Meeting. Boy talk about deep seated Anger these boys have problems. Obviously Comar has studied the rules quite closely and has made sure his pac skirts the rules. What he fails to realize is that when you set things up to skirt the rules you are accually breaking the rules. Any means to an end. Comar it the devil. Keep rolling him out it helps the cause.

Ok the truth must finally come out who the INSIDER really is. Are you ready? The person really is an insider, easily7 detected by his inside knowledge of the facts. It's STEVE McHARRIS the assistant planner to Warren Frace has been "leaking" information out of City Hall for years. He leans toward the environmentalists, tree huggers etc. and actually detests the developers in this town. He is constantly at odds with almost anyone that wants to develop in Atascadero. This blog has been his avenue to be the true INSIDER and is his attempt to get back at the people who have made his job unpleasant.

By: Anonymous on 5/28/08

The last few blogs just show the true hatred that exists in Atascadero, from both sides. The culprits in City Hall have been identified from the City Council members, City managers office and the Planning Department. All of you people are wasting your time attacking the wrong people, even though they may have done some misdeeds, but it is the people at City Hall that are turning the mudhole into a s__thole. If all of this energy was directed to the source of Atascadero's problems there may be some salvation for this town. After last nights city council meeting I hold out little to no hope of this city ever even coming close to being funstional.

By: Anonymous on 5/28/08

Wow, 317 blogs on this site, no wonder atascadero is broke, everyone is on this stupid site instead of out working making money or spending money in our town. Get a life people.

I think that group of nuts you hang with owe Mike Shearer an appology don't you?

By: Anonymous on 5/28/08

Oh by the way the "cops" theme. Thats what I mean about unimaginative. I already did that. You guys can't even have a creative thought as a group. By the way I checked a bunch of the stores on your Vision Atascadero list and they were all selling things from China. I think I might just boycot them for being hypocrites.

By: Anonymous on 5/28/08

Wrong again. I think Shearer was smarter than investing with Gearhart. Also he stands to make even more money on Gearharts way down since he gets to list and sell everything Gearhart has. You guys are not only liars your so unimaginative. I think we should be looking out for that Broadwater guy he's wound a little tight. Did you see that City Councel last night. I think we should send the PD over to his place and look for devises. He is scary. Oh and I think him Comar and Perkins pretty much showed there union lean. These people are NUTS. The ends do justify the means for these three craziesl

I guess you drink and that would account for the times when you can't spell for shit. The fact that your a realtor accounts for why you have so much time on your hands and of course your a Hurst investor. It all adds up dumass. You should be so embarrassed calling all those follish names to Ellen and Mike and many others.

It seems to me that O'Malley should have given everyone an apology, especially for the disrespect that he directed towards Mayor Brennler. Oh well, I would have been surprised if he actually decided to "man up" for a change and say he was sorry for any wrong doing.

By: Anonymous on 5/27/08

No love lost at the city council meeting tonight. O'Malley recommended to getting ANOTHER consultant to assist them with there meetings. Is there some pre school in town that can help these poor fools out?

By: Anonymous on 5/27/08

You hit the problem right on the button. Almost EVERYONE I talk to in town anymore just says "I don't care anymore."

Unfortunately it's that screwed up. With the gas crunch I don't have to drive to Barstow to see the ghost town, I did that last weekend driving thru Atascadero.

By: Anonymous on 5/27/08

I would hate to think that there are people out there that are spending so much time trying to figure out who INSIDER is!! My question is "WHO CARES." All opinions are only what you make of them.

By: Anonymous on 5/27/08

Ellen Beraud is probably just waiting for the check in the mail. Tom Comar and OPW have probably just spent a great deal of money on their Shield Initiative. Ellen will probably have to wait until the next check from the Unions come in and is processed by Comar and OPM. Then she will get her monthly stipend.

By: Anonymous on 5/27/08

When I first got on this story boy all the blogs were Brennler, Beruad lackeys just piling on O'Malley. No amount of insult or blood was enough for them. I'll bet Smokey and the Turtle would pay to see this site gone at this point. Sorry the Turtle doesn't have any money her supporters will have to anti up.

By: Anonymous on 5/27/08

to last insider

No I told you, you don't even have a clue as to who I am.

On another point I thought maybe we could have some kind of contest to help raise some money for Ellen to help her with her expenses in her efforts of trying to avoid the public (unless your OWM). Perhaps a nickname contest. She really does have many to choose from allready. "The Turtle" "Show me the Money" "Drive Thru" Maybe everyone sends a dollar in with thier vote. Those with the nickname that recieves the most votes could be placed in a hat and a winning name could be selected for a double double at "In and Out" (whoops maybe thats another name) and the remainder of the proceeds could go to Ellen.

By: Anonymous on 5/27/08

Rumor has it that the police and fire departments have been put on alert for this evenings city council meeting. Both agencies are fearfull that the continuing conflict between O'Malley and Brennelr could escalate into a civil disturbance. It's been revealed that Tom Comar and members of the OPW will be hiding in the alley should the altercation go outside of city hall. The Rottman Group has been silent on this and are awaiting their EIR to be completed.

National News agencies may be covering this story and the city manager and planning director have gone into emergency mode in an attempt to establish a fee structure for the news media that will be attending. For myself I'll stay at home and watch so that I will be able to turn it off when I get sick to my stomach watching the idiots perform.

P.S. Ellen Beraud is compaling about the panhandlers on the Curbaril off-ramp and is insisting that they be charged a fee for their presence, although as an ad on to her complaint she would be exempt from panhandling on any off ramp within the city limits.

First I don't know what Condos you are talking about, however you might want to purchase one as it will give you creek access at a really good price. Also it kinda promotes that public access thing you like so much since everyone in the HOA would own it in common. Kind of your own little mini socialist kingdom. Lastly I only post as INSIDER and I'm not anybody you have sugested. I do watch you very closely though. I can get closer if you will only give a puplic access on your property.

By: Anonymous on 5/27/08

You're right…I shouldn't have responded to Dumass/insider. I wish he'd start his own blog so he can write to himself all day and not waste this sites time.

Back on the O'Malley thing, I believe O'Malley was way out of line in his threats to Brennler. No matter WHOSE side you take, elected officials should try to be good role models and show respect for the community they represent. O'Malley and Clay realize they are a dying breed of "Good ole Boys" and that the other three are (POSSIBLY) going to change the direction of this town for the better.

By: Anonymous on 5/27/08

You mean to say that Ellen Beraud actually went to a fast food restaurant that had a drive thru window? I thought she was against all drive thrus. Sounds like we may need some more ethical training at City Hall. Votes no and then endorses the project. Does that mean that during hard times during the next few years ahead and her self proclaimed "hard times" that we might actually see her at Wal Mart?

By: Anonymous on 5/27/08

Things must really be getting bad for Beruad. She was actually spotted at a fast food restaurant, In-N-Out Burger, feeding her family. What a let down that she had to join the rest of us low lifes and eat at such an establishment that she abhors. Or maybe she is just the hypocrit that she is.

By: Anonymous on 5/27/08

Someone mentioned all of the debris in the creek. Maybe the city could have a study on how to set up a barrier behind City Hall and catch all that crap to add to their archives. Many they could also recycle the condom and try to prevent giving birth to any new ideas that they have for this City. There productive history has been very negative.

By: Anonymous on 5/27/08

Unless you agree with insider it's best to ignore the person(s). Let the syncophants speak to themselves. I've never seen such obtuse statements in all my life coming from a surposed educated adult. His statements shouldn't be dignified with relpies. Now they want to start a rumor that Brennler, Luna and Buraud are on welfare. It will never end with this dumb ass.

By: Anonymous on 5/27/08

Is this all about the creek?. last time i went to the crrek, all i saw was an old tennis shoe and a coule of spent condoms…what is the big deal?

By: Anonymous on 5/27/08

Hey, insider (Dumass) since your sh*tbox condos got approved, why are you still so miserable? Now you can have the position of your dreams! Slumlord! And no worry about trash removal for your tenants…they can just throw their dirty diapers in the creek and it will all just float away! I'm sure your neighbors will all approve!

By: Anonymous on 5/27/08

By: Anonymous on 5/27/08

Where is Ellen Beraud spending her $300 every month? You don't see her anywhere. She doesn't show up at any public city functions or civic club meetings. She refuses to meet with people and rather converse by email. She doesn't reply to emails either. About the only time we see or hear from Beraud is when she comes out of her shell and is at the city council meetings to hear her ramble on about nothing and then place her No vote on the issue. Ellen Beraud knew what the terms of "emplyoment" were from the beginning. If it's to hot in the kitchen get out. As far as I'm concerned none of them are worth $300 a month. I may have to take that back. With the cost of gas these days, along with the their high fee schedules and anti business environment it might be worth the $300 a month just to watch the comedy of errors on tv every other Tuesday night.

By: Anonymous on 5/27/08

Maybe Ellen could wear a nicely designed tin cup around her neck and when her admirers such as yourself see her out and about you could give her any spare change you might have.

By: Anonymous on 5/27/08

How did they ever get approval to build all of those condos along the creek. Of course it had to be the Realtors and Developers. WRONG-Our wonderfull city planning department came up with that idea during the rewrite of the General Plan. There was neighborhood opposition to these zone changes which meant nothing to staff. Property owners went before the Planning Commission and City Council arguing that the density increase (smart growth) would ruin the integrity of their neighborhoods along with a decrease in value of therir homes. The creek was also mentioned during these meetings. As we all know the city, not Realtors or Developers, didn't listen to the people and voted in the zone change to allow for a higher density and to provide for more "AFFORDABLE HOMES." A large number of these projects are along the creek. Folks this is smart growth.

So after creating the condos and allowing condos to be built behind the existing homes we now have impacted neighborhoods (smart growth) that everyone is complaing about. So before you start accusing people of things, you should begin at the root of all evil-CITY HALL.

By: Anonymous on 5/27/08

You are easy to identify. 1.You are jealous because you don't have a job or you are on the government welfare list like Luna, Brennler and Beraud.

2.You love Luna, Brennler and Beraud. You hate O'Malley and Clay.

3.You own no property, so property rights mean nothing to you. All you want is to be able to gain access to other people's property.

4.You are a card carrying member of OPM and AHA.

5.What have you done positively for Atascadero.

I will not call you a "Dumass" because you did that yourself.

By: Anonymous on 5/27/08

THREE TOP PRIORITIES FOR CITY BY BRENNLER AND BERAUD

1)Give the City Councel a raise

2)Stop Wal-Mart at all costs

3)Take personal property rights starting with the creeks.

By: Anonymous on 5/27/08

So now "Show me the money" Beraud has people campaigning to get her some more cash. Nice work Turtle.

By: Anonymous on 5/27/08

I agree that the city council members can't do their jobs (travel, site visits, internet, cell phones, etc) for $300.00 a month. They are working very hard for us. I think we should show some appreciation and cover their expenses.Increase the stipend.

By: Anonymous on 5/27/08

Atascadero City Hall is "over spending" and "over staffed". There is no need for two city managers and all of the planning staff. The salaries are out of line with the pay scale for SLO county in general. They have been living high on the hog and pull the city credit cards too.

By: Anonymous on 5/27/08

I think the City Council should receive more than $300.00 a month. They drive out to visit projects and meet with citizens, attend various meetings etc etc. The $300.00 propbably barely covers the price of gas. The legal current rate for automobile expense is 48.5 per mile. Give then a raise. They work for free and the work hard for us.

By: Anonymous on 5/27/08

I agree with all of I can see U's points. I also think its Buban or jackson or Burbach or all three. It's true that the mentality of the individual varies so I also suspect it could be more than one of them posting. Either way everyones knows about them and they have made massive fools of themselves all over town. Th party for them is over. The party here has just begun.

By: Anonymous on 5/27/08

Right On,

EXCELLENT POST. I think insider is more than one person because sometimes he can spell and knows a little bit and other times he can't spell for shit and is a blooming idiot. I think it's Buban or Jackson and the other real idiot is Burbach.

By: Anonymous on 5/27/08

to I can see U

Wrong. Guess Again

By: Anonymous on 5/26/08

And something else. Buban and Jackson actually did more harm to their creekside neighbors then good. If they just would have been polite in their opposition to the setbacks and stated their reason for opposing it was for privacy and protection of the creek, yadda, yadda, then folks probably wouldn't have paid too much attention and would have agreed with them. But when they started their big recall effort, the truth came out that the REAL reason they opposed the creek setback was because they wouldn't be able to build condos on the creek, then folks got concerned. Personally, I would rather see a simple foot path along the creek then a bunch of shoddy condos with people dumping their garbage out the window into the creek. So I will vote FOR the creek setback now! They should have kept their big mouths closed. Attacking Brennler and Beraud and then swirling Wal-Mart into the mess reveled them for the low-life that they are.

By: Anonymous on 5/26/08

If you want to know who "insider" is, it's simple He's an ass. Of the worst kind. He's either Ray Buban,. or Mike Jackson. Here's why:

A) He's on this list 24-7 and has nothing else to do. Sorta like a Realtor that's sitting at his desk all day with nothing to do but sit on the computer.

B)He HATES Brennler and Berud and Luna and LOVES Clay and O'Malley

C)He owns creekside property and fights against the creek setback because he wants to build condos on his land

D)He's so obsessed with WalMart and Comar that he has turned every single blog on this entire site into a fight about Wal-Mart.

E)He regularly attends all the CC meetings not so he can be of value, but just to try and catch Brennler and Beraud doing something he can cause trouble about.

Go ahead and deny it….we're on to you now. Dumass.

Wouldn't it be interesting if you found out I was actually inside OWM and AHA?

By: Anonymous on 5/26/08

It has to be Wade McKinney the City Manager for Atascadero. These blogs keep the heat off of his problems. Instead of the news being the FBI and Treasury Dept. investigation of his activities he has been able to divert these blogs to other topics. As long as he can keep EFI, Hurst, Gearhart and now O'Mally vs. Brennler in the limelight no one mentions his name. The O'Malley vs. Brennler fiasco is right up his alley because he can play both sides of the fence. And the of course who is on the INSIDE more than anyone else.

By: Anonymous on 5/26/08

You need to get on board with reality. You are blaming businessmen for the economy? Get a grab on what really causes thsi. Example the cost for a permit to build a house is close to 30% of the entire cost of construction. Sorry to say Realtors didn't cause this the beuaracrats that you evidently support have found it amuzing to "punish" the developers by increasing these fees. The end result of this is not affordable housing. Check on what worker's comp insurance costs in Calif. compared to everywhere else. Did the businessmen ask for this. Open up the yellow pages of the telephone book under attorney and see how full page ads there are for them to sue the businessman and anyone else they can rape. The end result of that is enormous liability insurance premiums. And then we have people, more than likely like you, that want to stonewall any and all projects that become before planning commissions and city councils. I would suggest that you take your extra time and become a businessman and then let us all know how it should be done.

By: Anonymous on 5/26/08

Who is insider? I was guessing O'Malley but he would know that you can't develop contrary to the General Plan. So it is probably one of the ignoramous realtors at ABA. Maybe Suzy Anderson or Jolene Horn or Michael Sherer (Peabody and Plum). With the dead real estate market they have nothing better to do than to monitor this site.

There is no creek setback. You are refering to the general plan. The Land Use Ordinance designates setbacks not the General Plan.

By: Anonymous on 5/26/08

Ya, right! We need more "businessmen" on the council like all the "businessmen" in the country that have made our economy third world.

By: Anonymous on 5/26/08

Thank You for your hard work , and solid sense of reason.

By: Anonymous on 5/26/08

There appears to be no common sense let alone any knowledge of financing. Tom O'Malley usually reminds us that he WAS an economic major. But Tom also voted in the outrageous fee structure that this city has. There answer to all of their problems is to charge more to keep paying for their surveys to figure out how to spend the money. George Luna has said that as far as he is concerned they couldn't charge the developers enough. Consequently if you happen to want to build your home on an acreage lot this cioty has determined that it will cost you an ADDITIONAL $18,000+. And I ask for what? It must be to cover the 6-9 month waiting period for the permit.

The crux to all of this is that this city needs to wipe the slate of council people clean, and I mean all of them, and put people on the council that will be fair to everyone on an equal basis. Of course that would be new to Atascadero. There needs to be business people in place that can counter the extraordinary needs of staff and curtail their spending habits. We need people that will address the needs of our emergency response personel. Do we need 2 city managers? Do we need 2 directors in the Planning Dept.? Do we need a full staff in the Planning Dept. when there is nothing to plan? It's time for a change.

By: Anonymous on 5/26/08

The creek setback IS 25 feet and even O'Malley and Clay voted for that.

By: Anonymous on 5/26/08

I fully expect these incompedents to come to city councel suggesting increasing fees to the public. Its already too expensive to build but these idiots will convince themselves that increasing the fees will bring them more revenue. Well what is the increase if you add an additional 10% fee to 0. Its time to move all fees and policies back to the structure of 15 years ago and get our city back on track. No inclusionary housing, reasonalble but appropriate development fees, and a streamlined permit process.

By: Anonymous on 5/26/08

Now is the time to find out what common sense these people have. We know "Show me the Money" Beraud will never make a move to bennefit this town. This city needs to make serious budget cuts right now. Every local and state agency in the area has done so accept Atascadero. Spending our reserves and hoping things will turn around is not enough of a game plan. Only O'Malley seemed to recognize the dire straights we are in. If this councel doesn't start making serious cuts and bring in a balanced budget now we should seriously reconsider thier tenure starting with Brennler and Beraud. If we are lucky enough to vote out Brennler maybe then we could reconcider the recall of Beraud. Apparently in her current financial condition we would be doing her a favorl

By: Anonymous on 5/26/08

Ellen Beraud having graduated from Berkely may be kidding us all. Could it be possible that she is writing the play book for Atascadero from her learnings at Berkely? They do kind of fall hand in hand. Power to the commies.

By: Anonymous on 5/26/08

Is the current city council serving the community? No, we have no tax basis, a dysfunctional council, a city manager who operates fraudulently and possible illegally, and a planning department that is also dysfunctional. Is this city council protecting our rights? No, they want our property to meet their personal agendas, they want to fee us for everything because their spending has ran out of control. The situation has deteriorated so bad that now we have to councilmembers, O'Malley and Brennler, wanting to duke it out in the parking lot. What an example for the community.

To Voter: Noooo!!! There originally was NO "creek setback" per-say, but there was the EG Lewis dedication and based on about 75,80 years of the Colony and forever before that the people that lived on the creek seem to have done very well taking care of it. So we do not need a bunch of inter-lopers coming in here and telling us what to do with our land, and we as voters are not going to give them anything.

Insider: I can not mention everything that is why you and people like you and I are out here, keep it up..

to to voter

What you also fail to mention is the unknown cost of these rocket science consultants you need to hire that can help you determin where the creek edge is and also do exhaustive studies in creek voodoo to predict future movement of the the creek. Also that any and every little swale on site is defined as a watercourse requiring setbacks for everything and anything.

You may want to add that the original setback suggested was 50 feet. There is also nothing very clear as to where the measurements would begin or for that fact end. They can't tell you if it's the center of the creek, which they also say moves. Or is it the top of the creek, wherever that is? Or is it the final setback from a property line? You can be rest assured though that wherever it ends up being there will be enough for the trail to go thru.

not so innocent, you really need to pay more attention to what is really happening: Ray and Mike did not state anything they reacted to a city counsel run amok. They are the only two in the city that had the guts to stand-up and say enough is enough and they are my hero's, oh yea that would be Ray Buban and Mike Jackson, never heard of a Mike Hunt, againg gets the facts straight. To insider: hey apparently you can read, then actually read the creek setback ordiance and you will read for yourself the part about public trails, you will also learn the portion where it state that the setback in not, what you are trying to minimize into 15 to 20 feet but 35 feet from the 10 year high water mark, read that!

insder; you really nee to get more inside, as the smokey bear and turtle reference is not what the Three Stupids are really called that would be: Dopey(george), Grumpy( mike) and last and least Sleepy (ellen)

Good morning Tom. Your mission today, should you accept it, is to apologize to the community for your actions and to consider taking a little time off to gather up your thoughts.

Let's get ready to rumble.

It's reported that Michael Buffer world renowned boxing ring announcer has been contacted by the city of Atascadero as possibly being the ring announcer for the "Rumble in the Hall."

When contacted Wade McKInney said he knew nothing about it. David Broadwater, Tom O'Malleys next door neighborhood, has claimed he overhead a convesation thru his fence that Tom O'Malley and George Luna were having about fight. Under the Freedom of Information Act Broadwater has put in a request for emails regarding the fight. Unfortunately George Luna's hard drive has once again failed. The word witin city hall is that the fight could be one of the biggest events to come to this town and promoters are anxious to set a date. The stumbling block appears that Warren Frace says his Planning Department may be able to expedite the permit process and have it ready prior to the November election. Steve McHarris from the Planning Department will be in charge of public relations and will be leaking information to the press. Due to the importance of this fight the city of Atascadero will put the application for Wal Mart on hold until the fight takes place.
