California judge reduces child rapist sentence

justiceA California judge reduced the prison sentence of a man who raped a three-year-old girl, because the rapist did not seek out his victim, he just became sexually aroused.

Last week, Orange County Superior Court Judge M. Marc Kelly reduced Kevin Rojano’s sentence from 25 years to life in prison, the minimum for sodomizing a child under the age of 10, to 10 years. Kelly ruled Rojano did not act as violently as he could have. [Orange County Register]

On June 4, 2013, the 3-year-old girl wandered into a garage where Rojano, a relative, was playing video games. When Rojano heard the child’s mother calling for her, he covered the child’s mouth mouth, locked the garage door, pulled the child’s pants down and sodomized her.

“Looking at the facts of Mr. Rojano’s case, the manner in which this offense was committed is not typical of a predatory, violent brutal sodomy of a child case,” Kelly said. “Mr. Rojano did not seek out or stalk. He was playing video games and she wandered into the garage. He inexplicably became sexually aroused but did not appear to consciously intend to harm [the victim] when he sexually assaulted her.”

Judges like this one are as dangerous to society as the child predators.


If someone does this to a child, and there is no guarantee of adequate punishment following a guilty verdict, the only recourse for the family is to punish the perpetrator themselves. That’s not good for society.
