Motions for dismissal and gag order continued in Tianna Arata case

While supporters of four Black Lives Matter protesters chanted for the judge to dismiss their cases, San Luis Obispo County Court Judge Mathew Guerrero continued the hearing on a motion to dismiss and a motion for a gag order because of issues with the filings.

Both the CHP and the California Attorney General questioned the timeliness of a motion for a gag order to bar CHP and SLO police personnel from discussing the case. In addition, Tianna Arrata’s attorney Patrick Fisher’s motion to dismiss the case was not properly served on the CHP or the city.

After the four plaintiffs agreed to wave time for a speedy trial, Guerrero set a continuation of the hearing for Dec. 3.

Arata is currently facing 13 misdemeanor charges for her actions on July 21, when she allegedly led approximately 300 protesters onto Highway 101, blocking all lanes in both directions for nearly an hour. Arata is facing one count of unlawful assembly, one count of disturbing the peace, six counts of obstruction of a thoroughfare and five counts of false imprisonment.

Last week, prosecutors filed four misdemeanor charges against Marcus Montgomery, 24, including false imprisonment, obstructing the free movement of any person in a public place, and resisting or delaying a police officer. Also, Joshua Powell, 23, is charged with obstructing or delaying an officer and Amman Asfaw, 22, is charged with false imprisonment.

Guerrero said that even though he is being transferred to family court in January, he will stay with the case.

Outside, protesters morphed from asking the judge to dismiss charges and the district attorney to dismiss the case, to promoting SLO Mayor Heidi Harmon’s reelection while criticizing her opponent and District Attorney Dan Dow.

Several speakers, including Rita Casaverde, the chair of the SLO County Democratic Party Central Committee, cursed as they asked the protesters to vote against local Republicans.

Casaverde referred to Dow as “b***h ass prima dona,” while another speaker mentioned Dow’s genitalia.

“This system is already f**ked up enough as it is, the unnamed male speaker said. “We don’t need someone to come along and stick his little dick in it, and bust a nut, and try to make it work.”

Shortly afterwards, a speaker sang a rap song while some of the protesters began dancing.

Once again this failing movement proves that they are militant, intolerant, bigoted and filled with vulgar hate speech. The profanity used in the presence of those children at this hate fest is very disturbing. We can absolutely tie the hate and intolerance to the local Democratic Party. Watch the video and listen. Is that really something to lead and be proud of? Then endorse a unstable failed Mayor Harmon? Sick people, really sick people


Tianna and the rest of the blm clan up for charges deserve their day day in court and the maximum sentences for their crimes. If their supporters want to continue to act and speak this way, they’ll never achieve what their stated purpose was. They HAVE FAILED miserably. Nice job Heidi and Tianna.

Last time I checked, Tianna WAS free. She’s not in jail.

Wake up, people, she does not care about black people or anyone else. She is using them and you for her own political gain.


The photo of the mother subjecting her three young children to this nonsense breaks my heart.

Tianna made her (poor) choices. She needs to deal with the consequences. She wants to be a big girl, let her own it.


Must be fun to prosecute these high profile yet relatively meaningless cases. More than likely, history will repeat itself (recall the Doobie Dozen incident) and the DA’s office will look stupid and foolish.


“Relatively meaningless cases?” Clearly you don’t see the big picture. These cases (nationwide) are essential to our democracy….yes, no law shall abridge free speech, or the right of the people to peaceably assemble. It’s not the free speech part that is at issue, these groups have been allowed to exercise their free speech for months so long as the assembly was peaceful. You can deflect all you want, but no reasonable person will claim that the groups actions during this particular event were peaceful. The Doobie Dozen case is not even close to this scenario, MJ dispensaries skirted the laws for years and sold “medical” MJ to so-called patients with unverified medical conditions. If you paid a “doctor” $150, you could get them to diagnose you with any medical condition you wanted. I won’t claim that there weren’t cases that warranted use of MJ, just pointing out the rampant abuse & fraud that was associated.


I’m afraid SLO has gone down the path of San Francisco, Portland and Seattle. Maybe never to return? At least for the time being it is definitely a different animal.


I definitely hope that GH is correct and SLO follows in the path of those three cities, who are among the most robust economies in the United States.

This is the part that makes most of us sick. Having been in the area for decades I’ve known members of the democratic party here and was once great friends with the ladys of the democratic party (forgot their actual name).


To see these idiots making a mockery of S.L.O. & our D.A. makes me want to vomit. Then they break into a stupid little rap by unknown boy while others begin shaking their asses in each others faces and they’ll walk away claiming they really did something while they slide dads credit card for some grub on the way to their furnished apartments to drink the night away.

Wow, do these speakers think that debasing themselves and the crowd with their offensive talk is going gain them any supporters? Did anyone get a video of their tirade? It would be great to share with the electorate.


I’m pretty sure this falls under the category of free speech. What am I missing?


You are not missing a thing. Everyone is free to make fools of themselves.
