Parents of Kyle Doan allege wrongful death, file suit

Nearly nine months after floodwaters swept away 5-year-old Kyle Doan of San Miguel, his parents filed a wrongful death lawsuit against multiple local agencies on Thursday. [KSBY]

The suit accuses San Luis Obispo County, Paso Robles and Caltrans of negligence, dangerous conditions of public property, failure to warn and of issues with actions following Kyle’s disappearance. Since Kyle Doan went missing, personnel from state and local agencies have conducted searches for the boy, but have failed to locate him.

On the morning of Jan. 9, Lindsy Doan attempted to drive through the San Marcos Creek bed outside of San Miguel with her son, Kyle Doan, inside her SUV, a route she regularly took.

But that morning, the storm waters crossing the rural roadway lifted her SUV and carried it into the swollen stream. Water began to fill the vehicle, and Lindsy Doan yelled at her son to come up to the front of the SUV. Lindsy Doan tried to grab her son’s hand, but the current pulled him away.

Kyle Doan floated away backward. His mother could see his face, and he looked at her before being swept away.

In addition, Kyle Doan’s family has spearheaded efforts to search the Salinas River area in North County. Hundreds of people have helped them search for the missing boy.

According to Google ou should expect to pay somewhere around $10,000 for a simple lawsuit. If your lawsuit is complicated and requires a lot of expert witnesses, the cost will be much, much higher.


Good luck getting a jury to reward your stupidity


When so much was being spent looking for the body, I almost said something regarding how it seemed like a waste of taxpayer dollars, but I held my tongue.


When it happened, I was upset at the parents, because everyone knew when those storms were happening not to be driving around. I felt at the time she was irresponsible.


Now, she’s suing the County and city of Paso Robles etc. and trying to get money, when she clearly shouldn’t have been driving. Almost every person in the County knew it was dangerous to be driving around, but she apparently didn’t, and her child died as a result. It’s tragic, but them suing is beyond ridiculous and should immediately be thrown out. Also, she and or her family should probably pay for all the extra hours spent looking for the body after her negligence in a dangerous situation.


I almost wonder if salivating lawyers swarm over grieving families like these and convince these vulnerable people that $uing people or entities we all know didn’t cause this tragedy will help in $ome way.


This community rallied around this family so beautifully and I fear after a headline like this, it makes sense many will look at this family differently.


I hope the Doan’s get the clarity and closure they truly need, not just the clo$ure they are told they deserve.


Sympathetic donors have already given $56,000 via a (still active) Go Fund Me acct. Generous co-workers pooled together their sick days for Kyle’s mom to use. Friends and neighbors made and delivered countless meals to the Doans. Cash, gift cards and other charitable items were likely received apart from the Go Fund Me campaign…yet the Doans want more??

It’s shameful, imo. No amount of $ will bring back little Kyle (RIP).

Other drivers that morning realized the creek bed was too dangerous to cross so they didn’t risk it.

I am sincerely sorry that Kyle’s mom made a bad choice to attempt to cross an unsafe, flooded creek bed, but filing lawsuits won’t bring back her son.

Such actions will, however, erode community support for the Doan family.

Again, RIP little Kyle.


I admittedly do not know all of the facts of this case, but I do know that it is deadly stupid to drive your car into surging water, especially with your kid on board.


I feel very sorry for her loss but she made a sad mistake at no fault of others. They search party spent endless time and money to help her and I don’t think they are suing her for it Let everything rest in piece as sad as it may be.


The lack of responsibility is literally disgusting. So much man power and time used looking for this little guy, when the mom didn’t use smart judgement let’s sue to make them feel better. They can pi $$ right off.


Accepting responsibility for the death of one’s child has got to be tough, particularly if one can find someone else to blame.


In the case of this parent, the money may or may not be an issue, but I am certain that it weighs in on the part of her attorney (grieving mother/dead child can be easily played up to a jury for a big payout, regardless of fault, just out of sympathy for the mother’s loss).


Blaming others for your lapse of parental guidance is not going to give you closure. Please face the facts: your misguided actions caused the death of Kyle: driving into swollen water resulted in what happened. Whatever sleeze lawyer tells you otherwise is only trying to line his/her pockets at your expense, face it, you f..led up be entering swollen water, you are the responsible party. Many tried to locate the body, you should just say “thanks” and live with the situation you created.
