Inmate Scott Peterson part of massive unemployment fraud scheme

Amid his bid to get his murder convictions overturned, Scott Peterson allegedly participated in a “massive” coronavirus-related unemployment fraud scheme that enabled other inmates and him, as well as their associates, to fraudulently collect hundreds of millions of dollars from the California Employment Development Department (EDD).

Sacramento County District Attorney Anne Marie Schubert said at a joint press conference with other prosecutors on Tuesday that of tens of thousands of local, state and federal inmates have been involved in the unemployment fraud scheme that has been occurring in in jails and prison in California.

“Every type of inmate that you can conceivably think of — murderers doing life or life without the possibility of parole; rapists serving hundreds of years at a sentence or perhaps life as well; child molesters; serial killers; and other murderers sitting on California’s Death Row. Hundreds of millions of dollars that may well amount to upwards of a billion dollars having already been paid in their names,” Schubert said. “It is perhaps and will be one of the biggest frauds of taxpayer dollars in California history.”

Unlike agencies in many other states do, the EDD did not cross-match unemployment claims against a list of prisoners, enabling inmate in California to easily exploit the system, prosecutors said.

Upon approving unemployment claims, the EDD would mail out debit cards that do not require identification for use. Individuals would go to ATMs with stacks of debit cards, extracting up to $1,000 at a time. After collecting unemployment funds, friends and relatives of inmates would send money orders to jails and prisons.

Also speaking at the press conference, United States Attorney for the Eastern District of California McGregor Scott said the federal government funded the majority of the unemployment money.

In September, the EDD temporarily stopped accepting applications for new unemployment payments amid a spike in fraudulent claims and allegations of widespread fraud. At the time, the EED said perpetrators were often using stolen identity information from national and global data breaches, as well as exploiting expedited payment efforts in the federal Pandemic Unemployment Assistance Program.

Nonetheless, prosecutors said Tuesday that inmates continued to exploit the system, even as investigators across numerous agencies probed the case.

Scott Peterson collected a currently unknown amount of money. Officials are withholding the total Peterson and other individuals fraudulently collected as they work to complete their investigation.

Peterson, a former San Luis Obispo resident, met his wife Laci Peterson while both were attending Cal Poly. In 2002, Laci Peterson, 27, was due to give birth in four weeks when she disappeared on Christmas Eve.

Nearly four months later, Laci Peterson’s remains washed up on a rocky shore off San Francisco Bay. A passerby found them a few miles from where Scott Peterson said he had gone fishing.

In 2004, a San Mateo County jury convicted Peterson of the first-degree murder of his wife and the second-degree murder of the fetus. He was sentenced to death for the murders.

Earlier this year, the state Supreme Court overturned Peterson’s death sentence, finding a juror failed to disclose she had once feared for her unborn child while being harassed by her boyfriend. Last month, the State Supreme Court sent the case back to San Mateo County Superior Court to determine whether the juror committed prejudicial misconduct by failing to disclose her prior involvement with other legal proceedings, including being the victim of a crime.

Now, Peterson could be transferred from death row to the San Mateo County Jail, which has also been one of the hotspots for unemployment fraud. San Mateo County District Attorney Stephen Wagstaffe said fraudulently obtained unemployment benefits from his county’s jail alone totaled between $250,000 and $500,000.

So almost $1B taxpayers money was fraudulently lost. And I guarantee you that the politicians and bureaucrats that allowed this will go unpunished. Folks, these are the same people that want run your healthcare.


How in the hell can this happen? Follow the trail through EDD and hold the incompetent, over compensated state employees and supervisor’s accountable and terminate them.


If there is anyone deserving of the death penalty it’s the scum bag. The overturning of it is his death sentence is terrible. Isn’t this convicted murderer of his wife and unborn child a Cal(Fascist)Poly alumni? He’d fit right in with today’s crowd at CP. I’m surprised they didn’t throw out the second-degree murder charge on his precious innocent child, saying it wasn’t a life by todays evil standards regarding a child’s right to life. That might be next. When the day comes, may he rot in hell.

I doubt large sums of money was credited to 1000s of inmate accounts.CDCR takes half of all money inmates receive and applies it to restitution and fines even though the victims end up maybe with 5 or 10% of the original amount, the state and the counties keep most of it claiming processing fees .Most EDD money was fraudulently obtained using inmates info ,inmate info is available on the internet along with any info needed to file a claim .In the 70s and 80s before CDCR began checking inmates would be released with $50k and well into six figures of social security and disability moneys on their inmate accounts .Now days most of that is being stopped , there is retired military and GOV employees that receive their retirement while incarcerated and of course 401k etc moneys . Some addresses were receiving 100s of EDD debit cards in 100s of different names


Thank you for real data, right wing radicalism is totally pro incarceration without healing, improving and re integrating. Prison is supposed to be a school, therapy, and retribution of crimes committed to be a better human.


Take away mail privileges and take the computers out of the prisons along with any electronic devices…..like TVs and radios…they are there for punishment not to get rich….and not to be trained how to steal better…..wake up Californians you are asleep at the wheel….

This the problem with Government is they have no checks and balance systems. The legitiment worker gets run thru the mill to get anything and the criminals cruise right thru. Like passing more gun and ammunition laws criminals don’t care or abide by those rules only the honest people get screwed.

Maybe this happened because our government can’t do anything right. They seem to prove it every day…


That might be true, but I always found it funny that often the same group of people who think the government can’t get anything right also somehow think that the government can be trusted to always get right determining who should get the death penalty. If ever there was a decision that you’d want to get right 100% of the time, it would be dealing out a penalty that is final and irreversible, yet somehow we fully trust the government with that one, but not with determining who gets unemployment?


And what does that have to do with this? Instead of EVERYONE acknowledging this is fraud on a grand stage, that once again the state govt demonstrated how out of touch they are and should be held accountable, some people feel the need to defend them by bringing up some other issue from left field. That kind of stuff serves no one.
