O’Malley threatens mayor with alley brawl

Atascadero City Council member Tom O’Malley challenged Mayor Mike Brennler to handle a dispute regarding council procedures his way, man-to-man out in the parking lot, said numerous attendees of Thursday’s “public trust and campaign reform workshop.”

During the conciliatory-turned-contentious meeting, O’Malley interrupted and argued with a speaker during public comment. Brennler asked O’Malley to let the speaker finish. When it appeared O’Malley couldn’t hear the mayor over the altercation, Brennler began waving his hand at the council member.

“If you don’t stop shaking your hand at me, we are going to have to meet out back in the parking lot,” O’Malley is reported by numerous witnesses to have said.

O’Malley did not respond to requests for comment.

Late last year, the council voted to hire a mediator at a cost of around $9,000 to oversee a series of meetings designed to help city leaders develop skills needed to foster publics trust and confidence. At the first meeting a few months ago, O’Malley is reported to have hurled insults and argued with Brennler and Tom Shanks, the mediator.

Shortly before O’Malley’s latest threat, Suzy Anderson, a member of “A Better Atascadero,” — a political action committee — accused council member George Luna’s wife Ursula of taking certain actions during an election eight years ago.

George Luna said he was not going to listen to “lies,” and walked out of the meeting. Anderson later said she was not speaking on behalf of her group.

Following lunch, Luna returned, and Brennler asked attendees to follow meeting decorum and refrain from personal insults and requests for fist fights. Shanks put a limit on public participation, and the focus turned towards public finance reform.

This is bulls**t!! The city owns many creek reservations and some non profits like the school district and water company do also. This is a land grab by people living along the creek wanting to pretend that they own public property!

The city definetly would like to have a trail from downtown to the lake. What some people don't know is that some of the creek reservations are privately owned. Placing a large creek setback would be the first step in "condeming" these private land owners from any use of THEIR property. With that in place the next step would be an attempt to gain access to the creek thru these private reservations. The reason more than likely would be that there is public property on either side that the city controls.

Whatever happened to if it isn't broke what needs to be fixed? I've been here for over 30 yeras and I can say there has NEVER been any problem with the creek, except for city hall, until the environmetalist came along.

This isn't the first time that the city has attempted to take people's property rights away, they have been doing it for years with tree preservation areas on private property. Basically if you want to improve your property and have to take a couple of trees out you are extorted to put a large part of your property (sometimes an acre or more) aside for this tree preservation area that you can NEVER use. So yes, the city has taken private property rights away, they have attempted to do it and they certainaly will try it again

I finally got to read this blog and went to the citizens for atascadero web site! So that's what happend to them! LOL LOL. I remember Cheryl Burbach flapping her mouth about the CFA and attending council meeting's spreading crap around and then one day the CFA was no more. Now I understand why they all resurfaced (months later)as the ABA. Too absolutely too darn funny. Kudo's to the genuis that made them their own web site.

The audio is difficult to understand with traffic in the background but I get what was going on. Public Trails on Private Property sign the ballott stupid.

Do I detect a NIMBY attitude here. It was OK to call everyone else NIMBY's when the open space was being over developed and rezoned and subdivided into postage stamp lots. It was OK to screw with all the property owners on Del Rio back in 2003 because it was all about the developers getting the biggest bang for their buck despite existing zoning ordinances. Now that it's the opposition it's suddenly Ok to be a NIMBY. You just don't want trails in your back yard. You know that no one can put public trails on your land, You don't want public trails on public land. I get it.

Cindy if you have so much confidence in some city officials not ever attempting to take your property I have one suggestion for you. Call Pat & Sue Gaughn and ask what the city attempted to do to them. Fortunately Marty Tracy let the cat out of the box on that one. When Mr. Tracy wanted a public hearing on what the city was trying to do to make him a scapegoat he was immediately reinstated at full pay and hidden away in city hall never to be heard again on how this city really operates. Do they want a trail along the creek? Go the creek north of Portola and ask if they would like to extend that trail to downtown. As sad as it is the city does have a history of deception and not telling the truth. Somewhere this is on theri agenda.

Good then lets just quit messing with our Land Use Ordinance. Its worked for years and will work just fine as it is. Just like you guys want to leave the General Plan alone I feel just a Srongly about you keeping your hands of of the Land Use Ordinance and out of my back yard.

Everyone needs to be concerned about any changes to the ordinance as it stands. The version of the Creek setbacks ordinance that was first brought forward by planning had extreme definitions as to what a creek and watercourse was and not only did it greatly restrict your property use over what you curently have it turned every line in the earth where two slopes meet into a water course. Since Atascadero is 100% sloping surfaces it meant that if you were the unfourtunate one to have two slopes converge on your property you have some type of a watercourse which is probably half of us. This meant each of these little swales would have setbacks. As too trails if you could or ever could devide your property the city could require puplic access in order to grant the division. Also the ordinance did have langauage that allowed puplic agencies to set up test devices on your property. Beware Brennler, Bereau, Luna, and Paterson all fully supported all of these concepts and only backed off of some at great puplic outcry. Don't let them fool you by talking about what they had in the final ordinace. That is just the thread in a sweater. When they pull the whole thread you'll be standing naked and they will be standing or hiking in your yard as is thier ultimate goal. Bureaucracy always seeks to increase its boundries. It never wants to give back your rights. Give them an inch and they will take a mile. If you ever want to do an addition, divide your property, or even sell your property be ware of these people. They will even create ordinances that will require you to retrofit your home before selling it. Just ask the allready troubled people of Los Ossos that recently were placed with a new ordinance that requires them to totally retrofit thier homes to low flow fixtures prior to selling.

I seriously doubt that there is one single Planning Commissioner or City Council member that would ever agree to put a public trail on someone’s private property. In fact they couldn't legally do it even if they wanted to (not that they would want to). I'd be the first one to lead a class action lawsuit but this isn't something anyone has to worry about.

Put an ordinance up for a vote with the current City Council to allow for trails along the creek. What do you think the results would be?

In a heartbeat Luna and Beraud would vote yes. Clay would definetly be no. Brennler would more than likely be yes. And Tom would probably go with the majority, could either be yes or no. This is where Tom is having his problem.

So are private property rights an important issue in this town?

Beware of the trails. If you go way back years ago during the preliminary meetings to rewrite the General Plan there WERE discussions about the trails. Those discussions were centered around providing a trail from downtown to the Atascadero Lake. So, the thought was there then and I'm sure it still lurks around today with some planners, Planning Commissioners and Councilmembers. Then we have to remember the creditbility factor that doesn't exist among some of the aforementioned groups. For once it appears there is a group of people that are pro-active regarding their personal property rights. One of the problems in Atascadero is that most action in Atascadero takes place AFTER some ordinance or land use issue has been passed. I ask, who do you trust? The citizens of Atascadero or the City?

It's Sunday and time to relax. I just read the story and it's fantastic in a shocking sense. I decided to say something because never have I seen SLO county so compromised. The banks, Hurst Financial, EFI, Gearhart (who I’m not sure about) the FBI and it goes on. We have never needed justice and honesty like we need it now. I urge those of you watching Mike Brennler to take notice of how he is being treated. He is a brave man who has nothing to gain except the pride of do the right thing , for the people and by the people. Take notice and ask yourselves what’s wrong with the current picture. I hope he’s willing to run again because he has earned my vote which sorry to say, he didn’t get the first time.

I'm sure he is a nice guy. He does all sorts of good things with Colony Days and participates in many local functions. The fact is that there are 2 Tom's. He also lies and doesn't respect or understand that he is elected to serve according to the will of the people. He manipulates and is the epitome of a Good Ole Boy in a bad way. He disrupts council meetings (but he isn’t as obtuse as his organized friends) because he likes to hear himself talk. If he would shut up and listen everyone could get out of the CC meetings earlier but he relishes watching(his friends) people like Suzy, and Burbach and Buban sport their ignorance and obnoxious behaviors. He is childish to the extent that he can't manage his anger about Mike & Ellen being elected rather than Grigger Jones and Bob Kelly. None the less he can also be a very nice guy. This isn't personal. He just shouldn't be representing the people of Atascadero any longer . Off to read the Sunday Paper now. This is always my first stop.

Jerry Clay is continuously disruptive at council meeting and fails to follow standard decorum. Mike is constantly having to remind him to follow protocol. O'Malley and Clay have to be clamped down on from now on. Enough is enough. Where is the city attorney. He needs to straighten them out and see to it that meetings are run in the best interest of the public rather than allowing certain members to rant over personnal issues. Regardless of what side your on or where you want the town to go the finger has to point to Tom O'Malley for his disruptive behavior, sarcastic remarks and his loss power struggle that led up to the fracas at City Hall. I've heard that during the last election he was pressuring Jones and Kelley to support him for eternal mayor in return for his endorsemnet. Both Jones and Kelley refused and Tom began to lose the power that he thought he had. There appears to be 2 Tom O'Malleys out there maybe a result of too many years at county mental health dept.

I admire the Atascadero City council majority for their patience, taking the higher ground and continuing, in spite of the resistence of the minority in town, to keep Atascadero growing in a way that will benefit the town, its downtown and citizens versus the few who have had the power in town for decades. The reason O'malley's funding dried up was because he lost control of the City Council. He couldn't do any more favors. If he could have taken control again and then made sure the right person got voted in (by the council) to replace him when he ran for county supervisor he would have been able to maintain his financial contibution support. It all fell apart when Brennler and Beraud won the election. Pood Tom and he thought that he was going to be the permanent Mayor. This is why he has such a neurotic dislike for Mike. The council will not be able to accomplish anything possitive with O'Malley and his trouble makers who are out to disrupt the public process at meetings. Just ask him to leave so we can all get on with business.

The citizensforatascadero web site was created the day that they announced themselves in the Atascadero News! Check out Vision Atascadero Website. Its non political and there to help keep tax dollars in Atascadero. Joan Main tried to derail them, can you believe it. Thats how messed up our Chamber of Commerce is. I'm sure that some of the people who supported the recall (seems like a better idea now, doesnt it) are part of the A Better Atascadero group. But this group just continues to grow and grow. The support for the recall was much broader than the OWM or the long haired freak show could ever imagine. Many who supported the recall were concerned about going public but now have moved on board to change the city council. No money, no business, no tax dollars, no development, 9000 to bring in a Dr feel good, seems like a great time to try to control more land by stealing creeks and increasing control. The hurry to change the campaign finance process is a feeble attempt to hold on the crazy circus.

I just saw the citizensforatascadero.com web site. Yes it made me laugh. I listened to the attached media player and it sounds like someone was telling someone else to sign a ballot because the city was going to put public trails on their property. The city said more than once that it wasn't true. Even the papers wrote that it wasn't true but I guess that didn't stop somebody from telling the public otherwise.

I was just told about this site. This is filled with info that we don't find out about through regular sources. It looks like Atascadero has gone completely crazy. There are a few culprits that don't want to respect the will of the people. Tom needs to resign. I'm discusted. It looks like we can't get anything accomplished at city hall with all this undermining of elected city council members. I'm basing my statements strictly on the behavior of elected officials and their supporters. I don't have a side one way or the other but I'm sick of the crazy people. There was a Santos fellow who used to play to the cameras and make an idiot out of himself. We all had to listen to him entertain his friends. As a result public comment had to be changed. This is all due to O'malley and Clay chumming up with these radical, rude, clueless group of bullies and deliberate liars. If you want to clean up Atascadero rum out O'Malley and Clay. Thats what I see from my perspective.

Rumor has it that after the confrontation between O'Malley and Brennler yesterday that Wade McKinney has called for a special meeting behind close doors, of course.

With failing revenue to the city McKinney is going to suggest that the city sponsor a pay for view fight between O'Malley and Brenneler and call it the Tuesday Night Fight at the Hall. So far we have heard that Jerry Clay will be the referee, George Luna will be the ringside analysis and Ellen Beruad will be the ring girl. With McKinney being the promoter he has met with the parties and their representatives. The Rottman Group will be behind Tom O'Malley and Oppose Wal Mart will be behind Mike Brennler. Up for stakes will be the vote for Wal Mart with the winner taking all.

Negotiations are still under way as to what date the fight will take place on. One stumbling block is that Warren Frace of the Community Development Department has stated that his staff is so busy trying to keep busy with nothing to do that it could possibly have the tickets ready for distribution within 6-9 months. An alternative plan was suggested that for an extra fee he could gurantee that the tickets could be ready hopefully within 6 months.

City Manager will be referring us to Rachelle Richard as to what the proceeds may be from an event like this.

Staff is encouraging this event to happen in hopes that it will resolve the problems within city hall.

I believe your probably talking about Dove Creek which was zoned commercial. You must go back a little further and recall that Rex Hendrix had a beautiful plan to develop that property commercially. The city of Atascadero turned down his plans and thru up the usual barriers for progress and the project died. If I recall correctly that is where Home Depot wanted to go. There was some shenanigans going on there also. I believe the Planning Director (who was brought here by McKinney) resigned after some disclosures on the negotiations. LUNA was there on that one. So along comes Dove Creek at a time when "affordable" housing is the big political hot word. So we get Dove Creek which was suppose to have 60,000 +/- of commercial buildings. Centex was smart enough to know that wasn't going to fly in this town and bonded for it and gave it up to the city. The ultimate consequence to that would have been an ADDITIONAL 60,000+/- sq. ft. of empty commercial building space. The special interest group that you must be talking about is the city, they are the ones that directed everything that has happened on that property. Oh the anti's are usually talking about all of the great profits for developers, could that be why Centex is attempting to give those homes away and get out of California?

Insider could be any number of people from the ABA group.

Many of us here know that the best thing to do about insider is to ignore him/her unless of course you agree with them. Insider slimes every blog and if you respond he.they will never stop with all the twist, spin, gibberish and outright egregious statements. His mindset and spin is very similar to what the “recall the b’s”used to do. They have taken down their web site probably in an effort to conceal all the foolish mis-information that they expounded as fact. The ABA can’t distance themselves from Burback, Buban & Jackson. A special interest group is a group or indivdual who is entirely out for themselves looking to gain something at the expense of others. A perfect example of special interst was all the residential development that took place in Atascadero. No consideration was given to commercial development which was badly needed. The influx of new residents taxed the cost of public services and water sources there was not suficent infastructure to support the town. This was the result of special interest who wanted to rezone commercial property so they could get more bang for their buck. The fact is that when the property was purchased it was zoned commercial use. Then they want to scream "personal property rights". What about everyone elses rights? That is special interest.

I think the ABA was at the meeting to undermine the Campaign Finance Discussions.

I also think it was Tom O'Malley and Jerry Clay who put them up to it. There is no reason for the public not to want campaign contributions limited to a maximum contribution per citizen or business owner. Except for someone that wants to line their pocket with "special interst" money.

Atascadero has always had people of differing opinions but not untill Smokey the Bear Brennler and Ellen the Turtle Bereau being pushed by their special interest groups of Oppose Wal-Mart and the Atascadero Homeowners Association has this community been so devided. There are special interest groups to be concerned about but contrary to your views they are OPM and AHA. Did you mean "A Better Atascadero" website? I think you had a freudian slip there. ABA are the group from "recall the b's". They have always delivered mis-information. I haven't looked at the site and know that there isn't anything there that will be close to factual. The reporters at uncoveredslo do their homework and interview everyone who has a part in a story in an effort to tell both sides. Usually the people with something to hide don't want to talk then they cry "one sided story".

I know that what I read here is factual even if I don't always have both sides. I also know there is no excuse for the behavior of MS Anderson or Mr. O'Malley.

I’m shocked by this behavior. I don’t know what has certain CC so upset but the public forum is no place to “act out” like that. I have to wonder what councilmen O’Malley is really doing. This couldn’t be all about Wal-Mart. There has to be more to it. I know he isn’t in favor of campaign finance reform but at the same time the people have a right to insist that special interest stay out of our elections. There was a time when the City Council had a majority that voted with O’Malley. This went on for many years. Luna and Pacas “sucked it up” and did their best to represent the citizens. I have to believe that a large part of councilmen O’Malley’s anger centers around the fact that he doesn’t control the city council anymore. This would account for his clear distain for Mike Brennler. If councilmen O’Malley can’t respect and support the choice of the people then it is time for him to resign. I for one will not tolerate his behavior for a minute longer. I hope the Major sanctions him.

The meeting confirmed that the City Council is dysfunctional. It also confirmed that another $9000 was wasted and put us closer to bankruptcy.

Hopefully another study will not take place in an attempt to determine what has gone wrong.

I notice that when people don't like these stories they scream "lies" but can never tell us what the lie is. If they do indetify what they are calling a lie it ends up being proved as a fact or truth. This site Rocks

Saturday morning the Atascadero Police Dept. received a call of a disturbance at City Hall. Upon their arrival at the scene they observed 2 male "adults" in a verbal confrontation (Mayor Brennler and Councilman O'Malley). Police observed one man waving his arm at the other who was threatening him about entering into a physical altercation in the alley. Police were able to quell the disturbance with the help of a crisis mediator who was also at the scene. While gathering information on the incident it was revealed that a key witness to the event had left the scene of the crime (Councilman Luna) Police were advised that he may be at his residence exchanging hard drives in his computer. After investigating the crime scene and interviewing those involved it was determined that no crime had been committed. Police advised both parties that they should probably terminate their relationship before it turned into something physical. Police also advised both parties that if they were called back again regarding similar actions that they would have to move out of their house, city hall, and relinquish any authority over the residence that they had and also that they could not move back in during the November election.

Rumor has it that Jerry Springer will be at city hall on Tuesday to apply for an apllication to film the next City Council meeting.

I've just looked at the A Bitter Atascadero web site. The amount of misinformation, distortion and outright dishonesty on their site would make George Bush blush. I guess they assume Atascadero voters are pretty dumb. It is a sad day for them when they can't make a point without lying about the facts.

You know I was really beginning to get irritated that there was absolutely nothing scheduled to do in Atascadero over this weekend. Every other community has something to do which will cause me to spend a little extra money on gas and go out of town and leave my sales tax somewhere else. I might even go to Wal Mart to vent my frustration. But wait, here at the last minute Brennler vs. O'Malley has created something for us to do here on this blog. I wonder if there's any chance that we could get the two of them to meet at our new, uncompleted, $9.4 million dollar community/recreation center over the weekend and just plain duke it out.

Planning Dept. could set up an emergency kiosk and issue permits for everything under the sky. Another great holiday in Atascadero.

Thanks city council for doing such a great job. I'll be up in Paso having a good time.
