SLO man claims consensual bondage, not torture
September 26, 2014
A Ventura woman testified Thursday against a San Luis Obispo man she accuses of torturing and attempting to kill her. His attorney says the couple was into bondage.
Earlier this month, 33-year-old Timothy Hayes allegedly bound the woman, 27, with tape and assaulted her with a knife, scissors, a pool cue and burned her with kitchen utensils. Hayes, who faces a possible life sentence for torture, attempted murder and other charges, appeared in San Luis Obispo court Thursday for a preliminary hearing.
At the hearing, the victim testified that Hayes and she had been enjoying a relaxing couple of days together at his San Luis Obispo home when, out of nowhere, he turned on her and tortured her for three hours with masking tape, a pool cue, golf balls, a metal ruler and a heated Hibachi knife.
“It turned into a lot of punching and kicking with full force, as if like a male-on-male fight,” the woman said in court. “I was thrown against the wall and kicked as hard as a soccer ball.”
The victim also said Hayes threatened to cut off her breasts with a pair of 12-inch scissors, saying, “Babe, I need these for myself.”
Defense attorney Ilan Funke-Bilu responded in cross-examination with questions suggesting that the victim was under the influence of cocaine at the time, was motivated by money and was into sexual bondage.
When Funke-Bilu asked the woman if cocaine was a regular part of her relationship, she responded, “Yes.”
The woman also said that Hayes and she had previously used tape for sexual pleasure.
Hearings in the case resume on Oct. 8.
