Kelly Gearhart’s trial delayed again

For the second time, onetime Atascadero “Person of the Year” and prominent North County land developer Kelly Gearhart’s trial has been delayed.

Kelly2Gearhart’s public defender, Kim Savo, requested the delay that has postponed the trial from Jan. 29 to June 11 for a variety of reasons including the need to have more time to review financial documents, recordings of a radio interviews from the Dave Congalton Show and phone recordings, according to court records.

In August, Gearhart pleaded not guilty to 16 charges of mail fraud, wire fraud and money laundering at a federal court in Los Angeles. He faces up to 300 years in federal prison if convicted on all charges.

Gearhart and the former president of Hurst Financial, James Miller, have been accused of helping to defraud more than 1,200 investors of more than $100 million in an alleged Ponzi scheme. Miller and Gearhart bilked investors who put money into Central Coast real estate projects and then siphoned off the monies for other purposes, including maintaining lavish lifestyles, federal authorities alleged.

In the summer of 2011, Miller agreed to plead guilty to charges of fraud and money laundering as part of a plea agreement the court then filed under seal.

Oh, even attempting to make a 10% return on ones money is very risky… the choices that have to be made can keep one up at night…


I really find it hard to believe that when it is all said and done that very much of anything will be recovered.


So many seniors lost their life savings because of the Gearhart Hurst Financial debacle. And the Pe Ji Ho Ta casino buy in. Myself and others have done our best to see that other’s won’t be ripped off buy this RICO violating crew.

Roger? There is a difference between assisting someone making an investment and knowing the investment is a dunker


“Justice delayed is justice denied”. That holds true here as the citizens who were wronged will not see justice done in a timely manner.


Just in time for Atascadero’s much-hyped Centennial Celebration! Maybe Kelly will fly home to make an appearance.


Now there’s an idea. How about a float in the parade. Kelly can stand in the middle surrounded by McKinney and his council favorites like O’Malley, Clay and Fonzi. I’m sure fellow citizen of the year, Grigger Jones can also find a place of honor on the float.

Kelly Gearhart as a young “fair haired” “in-the-car” Prison Guard ***Correctional Officer***was a most favorite son from the Warden, Captain, Lieutenant’s, and Sergeant’s, all the way down to the “in-the-car” Officers.

Way back then they were in his pocket, and he was in their good graces getting whatever jobs and or days off he needed that allowed him to do his contracting and in-house favors.

He made good money both as a Corrections Officer and as a young contractor doing favors for those in positions of POWER. The influence he yielded has always been far reaching.


I think the city of Paso Robles should hire him.


Good suggestion, Pelican. Kelly could have his choice: City Manager, Police Chief or School Superintendent. Paso’s so messed up; Kelly couldn’t do much more harm here anyway.

Seeing the delay doesn’t surprise me, as I have seen all types of trials delayed because of evidence gathering.

Don’t confuse as saying I like, just not surprised.


One that DOES surprise me is the sentencing of Miller. That has been postponed four times. I have never seen sentencing go past two postponements. That is the one that has me wondering what the hell is up.


The longer they delay Miler sentencing the longer they will have him available to “talk” and tell the truth about what Gearhart, Miller, Grigger Jones, Molina etc. what was really going on.

If and when this ever goes to trial, it will be revealed that the attorneys have spent (not earned) whatever money that has been found. The more one steals the more he/she can get away with it!!


Which attorneys are you speaking about? From what I am reading in this article, Gearhart has a public defender, and of course, there will be the prosecuting attorney(s); so which attorney is going to get all that money?


The attorney who was according to Gearhart’s stepmother (his right hand guy and the two were “thick as Thieves…..Robert Grigger Jones? Why isn’t he defending Gearhart? Conflict of interest maybe?


LE, DA, or Judge wants only the easy busts, not the hard complex ones.


There has always been a different sentiment of law and handling difference between the rich and the poor criminals.


The ultimate resultant of this case will likely be some form of light slap on his hands, a little blood to satisfy us in the arena as a plecebo to show they are doing their jobs for the big bucks benefits they are going to receive in retirement (Plus bribes and fringe beneits of their jobs).
