California judge reduces child rapist sentence

justiceA California judge reduced the prison sentence of a man who raped a three-year-old girl, because the rapist did not seek out his victim, he just became sexually aroused.

Last week, Orange County Superior Court Judge M. Marc Kelly reduced Kevin Rojano’s sentence from 25 years to life in prison, the minimum for sodomizing a child under the age of 10, to 10 years. Kelly ruled Rojano did not act as violently as he could have. [Orange County Register]

On June 4, 2013, the 3-year-old girl wandered into a garage where Rojano, a relative, was playing video games. When Rojano heard the child’s mother calling for her, he covered the child’s mouth mouth, locked the garage door, pulled the child’s pants down and sodomized her.

“Looking at the facts of Mr. Rojano’s case, the manner in which this offense was committed is not typical of a predatory, violent brutal sodomy of a child case,” Kelly said. “Mr. Rojano did not seek out or stalk. He was playing video games and she wandered into the garage. He inexplicably became sexually aroused but did not appear to consciously intend to harm [the victim] when he sexually assaulted her.”

Aside from the utter depravity here,if the law says 25 years to life for this crime, how can the judge legally reduce that sentence? I don’t get it.How could there ever be mitigating circumstances in the rape of a three year old?


I hope someone offs him in prison – child molesters are often targets in prison because many inmates have children outside whom they cannot protect from these creeps.


But no worries, under realignment he’ll be in the county jail and out in 3 years or less.


I always said I would take my chances with the criminal justice system if someone did something like this to one of my children. I couldn’t help but think the jury would be more sympathetic to an outraged parent than a child molester. Ellie Nesler lives!

If karma exists, when he gets out the next time he becomes inexplicably sexually aroused I hope he rapes this judge or a member of the judges family.


Anyone who would do something like this to an innocent child deserves to be killed. Anyone who would justify it deserves the same.


They thought Rex Allen Kreme wouldn’t rape again either.

I am going to confess something here: my husband and I experimented a lot when we first got married. That particular sexual act was so hideously painful as an adult, consenting woman-that I was literally in tears and very shocked. My husband felt so terrible for me….now….can you imagine how that was for a mere toddler???? I simply cannot. It had to have required sutures.


Absolutely–without a doubt—this judge must be taken off the bench! Sure, I say that but in Orange County; LA County….they are jaded and soul-dead…no one cares….it will just become water under the bridge…

there ‘s the justice system for ya. he raped a fu**ing three year old!!, but because the three year old wandered into a garage and he didn’t go to her, he gets off, most likely to do it again.?? thats worse than letting off a bank robber because he just happened to be walking by and “inexplicably became” urged? wtf? somebody should atleast kneecap this guy when he gets out

wow because he did not have to go looking for her, his sentence gets cut. If that was his daughter he might not think the same way but that was a very violent thing to do. Why is this different from offering them toys or games at his house and then getting arousing a raping her.


This lacks any common sense, a pedophile is a pedophile no matter if the child goes to his house or he goes looking for them. This guy needs to be removed from the bench.


I swear in no time we won’t even have people going to jail, we will just keep making excuses and letting them go or not even arresting them to start with. I think this state is getting a bit to liberal for even me lately.

The FBI should confiscate this Judges home computer before he deletes all pertinent emails from his personal server. They should also check his government computer / server.

I can in the context that maybe the judge is a pedofile …. because no decent judge would allow this travesty of justice. The judge should be thrown into prison along with perp.

this in anyway relevant to sodomizing a three year old? It is shameful what this judge has

done.

I cannot fathom this ruling at all.
