Kelly Gearhart’s trial delayed again

February 3, 2013

For the second time, onetime Atascadero “Person of the Year” and prominent North County land developer Kelly Gearhart’s trial has been delayed.

Kelly2Gearhart’s public defender, Kim Savo, requested the delay that has postponed the trial from Jan. 29 to June 11 for a variety of reasons including the need to have more time to review financial documents, recordings of a radio interviews from the Dave Congalton Show and phone recordings, according to court records.

In August, Gearhart pleaded not guilty to 16 charges of mail fraud, wire fraud and money laundering at a federal court in Los Angeles. He faces up to 300 years in federal prison if convicted on all charges.

Gearhart and the former president of Hurst Financial, James Miller, have been accused of helping to defraud more than 1,200 investors of more than $100 million in an alleged Ponzi scheme. Miller and Gearhart bilked investors who put money into Central Coast real estate projects and then siphoned off the monies for other purposes, including maintaining lavish lifestyles, federal authorities alleged.

In the summer of 2011, Miller agreed to plead guilty to charges of fraud and money laundering as part of a plea agreement the court then filed under seal.

Every time his attorney gets a fart crosswise, they ask for a trial delay.

Molina and “Grigger” are probably worrying about those phone conversations too, being they were the conspirators involved with the Pejihota con deal. The faction of the Salinian tribe that tried to get Federally recognized so they could reap the rewards of a casino, things are not going too well for them. They are a small part of the tribe, and getting smaller because of their actions. The true Salinians are becoming active again and proving that they are there for the people and not to use them to make money for themselves.

I agree Smiling Jack having lived the Pe Ji Ho ta scheme vis a vis what we allege were the questionable fundings for the buy in to the casino. Interesting that the buy in was the exact amount $646,000 of our father’s stocks that were cashed out by Grigger Jones and our stepmother only three months after Dad died.

If you wait long enough people come forward, as they have been with this Gearhart situation, telling the truth. Three people have contacted me in the last several months stating they fired Grigger Jones because they were concerned he was going to rip them off the same way he committed fraud and forgery to take over our father’s trust.

Public Defender? I bet he has more money than the entire Public Defender’s Office. Outrageous!!!!

That lying scumbag should have been in prison years ago.

The public has been fublicked again!
