California ordered to change the sex of an inmate

A federal judge has ordered the state of California to allow a prison inmate to undergo gender reassignment surgery. [LA Times]

U.S. District Court Judge Jon Tigar ruled in San Francisco that the state was violating Michelle-Lael Norsworthy’s constitutional rights by refusing to provide her care for a “serious medical need.” Norsworthy, a 51-year-old who is serving time for second-degree murder, was born a man but has identified as a woman since the 1990s.

If the gender reassignment operation occurs, it will be the first in state prison history, said Joyce Hayhoe, a spokeswoman for California Corrections Health Care Services. The surgery could cost as much as $100,000.

Norsworthy has suffered severe dyshporia, or dissatisfaction with her life, due to her natural-born gender, Tigar said in the ruling. The only adequate medical treatment for her gender dysphoria is sexual reassignment surgery, the judge stated.

The ruling also said that Norsworthy was denied the surgery because the Department of Corrections has a blanket policy barring transgender inmates from receiving reassignment surgeries.

Norsworthy began life with the first name Jeffrey. She entered prison in April 1987, prior to identifying as a woman, according to records.

Norsworthy was diagnosed with dysphoria in January 2000, according to the judge’s ruling. She is currently housed at Mule Creek State Prison, a facility exclusively for special needs.

The ruling states that the operation must take place in the near future.

This is almost too ridiculous to accept as truth. With Obamacare, and a large number of doctors now refusing Medicare, regular people can’t even get into see doctors, but someone who is in prison because of violating the law and rights of taxpayers through criminal behavior is entitled to a non medically necessary, elective surgery. There is something more than a little wrong with this story. Commit a crime, go to jail used to be a bad thing. Pathetic application of law and the constitution.

Unbelievable! Why not just release the guy and save us taxpayers a lot of money? He/she won’t get this if out of prison and it costs a fortune to keep prisoners in prison anyway.It’s just a scam to get out of prison for a while. Get real!

I think they need to treat this such as a doctor would, where is the “medical necessity”? It appears it took this guy 3 years to figure out a scam to pull while in prison. I don’t think he ever thought it would happen, because it SHOULDN’T.


I would like to know why he is serving time, did he do it because he was a man. What in the hell is this surgery going to do to make sure he is not going to commit crimes when he gets out.


This is just getting nuts, we do liver transplants, and now sex change operations. We let you get a drivers license and not be here legally, next thing you know we will give them menus so they can order what they want for dinner, heaven forbid they not like the food. No country club prisons for white collar crime, and general population no more pampering this jokers who want to do crime.


How about we give them a cot and 3, no t.v’s, no weights, no conjugal visits, bring back the chain gangs to clean up the trash on the streets, let them work a prison garden to grow all their own food. No sleeping all day, get there asses up and let them work 10 hours day in, day out until they get released. maybe then they won’t want to come back.

How about a prisoner who wants to change from old person appearance to young person appearance and needs complete cosmetic surgeries? It is serious medical situation because without it, prisoner will not be satisfied with life. Without such a surgery, a prisoner may suffer ageism.

“So God created people in his own image; God patterned them after himself; male and female he created them. God blessed them and told them, multiply and fill the earth and subdue it” (Genesis 1:27-28, 31) These godly inspired words explicitly tells us that our Hebrew God’s creation was excellent in every way, whereas no transgender is in the equation! To say that the given gender at birth does not matter is to disagree with God’s design for creation and His proclamation that it was good.


Read the beginning of Genesis 1:27 again, do you really think our Hebrew Christian God wants to be mentioned as being in the image of a transgender individual, even though He created this person? NOT!

Did you even read the story? This is a federal judge. Your comment suggests that California’s denial of this surgery makes it “the reigning state of idiots,” in other words, that you think this surgery is just great, peachy keene, or whatever.
